Terms of Service

These terms govern your use of this website and any engagement with Sigma Tech India (“we”, “us”), based in Bengaluru, Karnataka, India. By contacting us or engaging our services you agree to these terms. A specific written proposal or contract for an engagement, where signed, takes precedence over anything inconsistent here.

Our engagement model

Every engagement follows the same, transparent path:

  • Free on-site audit. We study your operations, data and the bottleneck you want to fix, at no cost and with no obligation.
  • Architecture & costed proposal. We propose a solution with a clear scope, deliverables and price.
  • Build & deploy. We engineer and deploy the system end-to-end.
  • Pay only when live and satisfied. Payment for the agreed scope becomes due once the system is live and you are satisfied it meets the agreed acceptance criteria. Changes beyond the agreed scope are quoted separately.

Intellectual property

Ownership of the custom deliverables we build for you transfers to you upon full payment for the relevant engagement. Until payment is received in full, all deliverables remain our property. We retain ownership of our pre-existing tools, libraries, frameworks and general know-how, and grant you a licence to use them as embedded in your delivered system. Third-party and open-source components remain governed by their own licences.

Confidentiality

We treat the operational, technical and commercial information you share with us during an engagement as confidential, use it only to deliver the work, and do not disclose it to third parties except as needed to deliver the engagement or as required by law. We expect the same protection for confidential information we share with you.

Warranties and liability

Except as expressly stated in a signed engagement, our services and this website are provided “as is” without warranties of any kind, whether express or implied. We do not warrant that the site will be uninterrupted or error-free. To the maximum extent permitted by law, our total liability arising out of an engagement is limited to the fees paid for that engagement, and we are not liable for indirect, incidental or consequential losses. Nothing in these terms excludes liability that cannot be excluded under applicable law.

Governing law

These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them or from an engagement, unless a signed contract states otherwise.
